Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between the mosque, Islamic centre, or organisation ("Customer", "you", "your") and Masjida ApS, CVR 44177099, Åbenråvej 10, 4200 Slagelse, Denmark ("Masjida", "we", "us", "our"). By creating an account or using the Masjida platform you accept these Terms in full.

These Terms apply to mosques and organisations that subscribe to Masjida. If you are a member of a mosque using Masjida, please refer to our Member Terms of Service instead.

Definitions

  • "Platform" — the Masjida web application, admin dashboard, public mosque websites, and any associated APIs operated under masjida.com, minmoske.dk, and mojdzemat.ba.
  • "Tenant" — an isolated data environment created for a single mosque or Islamic centre within the Platform.
  • "Member Data" — any personal data that the Customer uploads, creates, or manages about its own members through the Platform.
  • "Subscription Plan" — the pricing tier (FREE, BASIC, PRO, or NETWORK) selected by the Customer, which determines available features and usage limits.
  • "Authorised User" — any individual granted access to the Customer's admin dashboard (e.g., mosque administrators, board members).

Description of Service

Masjida is a multi-tenant Software-as-a-Service platform that provides mosque administration tools, including but not limited to:

Member registration and management
Membership plans, subscriptions & invoicing
Payment collection (Stripe, Vipps/MobilePay, bank, cash)
Donation management & tax deductions
Prayer time schedules
Event management and RSVP
News and announcements
Public mosque website hosting
Infoscreen / TV display
Organisation-level management

Feature availability depends on your Subscription Plan. We reserve the right to modify, add, or remove features with reasonable notice.

Account Registration & Access

  1. To use the Platform you must register a mosque account and provide accurate, current information (mosque name, contact email, address).
  2. You are responsible for all activity under your account and must keep login credentials confidential.
  3. Each mosque is a separate Tenant. You may only access data belonging to your own Tenant.
  4. You must designate at least one Authorised User with the ADMIN role. You are responsible for all actions taken by your Authorised Users.
  5. You must not share credentials, attempt to access another Tenant's data, or circumvent any security measures.

Subscription Plans & Billing

  1. Plans. The Platform offers FREE, BASIC, PRO, and NETWORK tiers. Plan features and limits are described on our pricing page and may be updated from time to time.
  2. Billing cycle. Paid plans are billed either monthly or annually, as selected at the time of subscription. Prices are stated in the currency applicable to your billing region and are exclusive of VAT unless otherwise stated.
  3. Payment. Payments are processed through our billing partner. You authorise recurring charges for the duration of your subscription.
  4. Upgrades & downgrades. You may change your plan at any time. Upgrades take effect immediately with prorated billing. Downgrades take effect at the end of the current billing period.
  5. Late payment. If payment fails, we will notify you and provide a 14-day grace period. After the grace period we may suspend access to paid features until payment is received.
  6. Taxes. You are responsible for any applicable taxes (VAT, GST, etc.). Danish customers will be charged 25 % Danish VAT. EU B2B customers with a valid VAT number may apply the reverse-charge mechanism.

Customer Responsibilities

  1. Lawful use. You will use the Platform only for lawful mosque administration purposes and comply with all applicable laws, including but not limited to the EU General Data Protection Regulation (GDPR), the Danish Data Protection Act (Databeskyttelsesloven), and applicable anti-money-laundering regulations.
  2. Member data. When you collect and manage Member Data through the Platform, you act as the data controller under GDPR. You must have a valid legal basis for processing Member Data, and you must inform your members about the processing in accordance with GDPR Articles 13–14.
  3. Consent. Where you collect consent from members (e.g., for marketing emails), you are responsible for ensuring consent is freely given, specific, informed, and unambiguous.
  4. Accuracy. Prayer time data, event information, and other content you publish through the Platform is your responsibility. Masjida does not verify the accuracy of content you create.
  5. Payment configuration. If you enable online payments, you must configure your own payment provider accounts (e.g., Stripe, Vipps/MobilePay) and comply with their terms of service. Masjida does not hold or manage funds on your behalf.
  6. Prohibited content. You must not use the Platform to distribute content that is illegal, incites violence, is discriminatory, or violates the rights of others.

Data Processing & Ownership

  1. Your data. You retain full ownership of all Member Data and content you create on the Platform. Masjida claims no intellectual property rights over your data.
  2. Data processor role. When processing Member Data on your behalf, Masjida acts as a data processor under GDPR. The processing is governed by a Data Processing Agreement (DPA) which forms part of these Terms (available on request at [email protected]).
  3. Tenant isolation. Your data is logically isolated from all other Tenants. No other mosque or organisation can access your data through the Platform.
  4. Data portability. You may export your data at any time. Upon termination of your subscription, we will make your data available for export for a period of 30 days, after which it will be deleted.
  5. Sub-processors. Masjida uses the following categories of sub-processors: cloud hosting (EU-based), payment processors (Stripe, Vipps/MobilePay), email delivery, and file storage (S3-compatible, EU-based). A current list of sub-processors is available on request.
  6. Sensitive data. If you store special-category data (e.g., religious affiliation is inherently implied by mosque membership), you acknowledge you have a valid legal basis and have conducted any required Data Protection Impact Assessment (DPIA).

Payment Processing for Members

  1. The Platform allows you to collect membership fees, donations, and event payments from your members via integrated payment providers.
  2. Direct relationship. Payment provider accounts (Stripe, Vipps/MobilePay) are opened in your name and belong to you. Masjida does not act as a payment intermediary, does not hold funds, and is not a party to transactions between you and your members.
  3. PCI compliance. The Platform does not store credit card numbers. Card data is tokenised and processed by PCI DSS-certified payment providers.
  4. Tax deductions. If you enable tax-deductible donations (e.g., collection of CPR numbers in Denmark), you are responsible for reporting to the relevant tax authority and for ensuring the secure handling of tax identification numbers. Masjida encrypts such data at rest.
  5. Refunds & disputes. You are responsible for managing refunds, chargebacks, and payment disputes with your members and payment providers. Masjida has no liability for payment disputes between you and your members.

Intellectual Property

  1. The Platform, its code, design, branding, and documentation are the exclusive property of Masjida ApS and are protected by Danish and international intellectual property law.
  2. You receive a non-exclusive, non-transferable, revocable licence to use the Platform for the duration of your subscription, solely for mosque administration purposes.
  3. You may not copy, modify, reverse-engineer, or create derivative works based on any part of the Platform.

Service Availability & Support

  1. We aim for high availability but do not guarantee uninterrupted service. Planned maintenance will be communicated in advance where practical.
  2. Support is provided via email at [email protected]. Response times depend on your Subscription Plan.
  3. We may temporarily suspend the service for maintenance, security updates, or legal compliance.

Termination

  1. By you. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial periods.
  2. By us. We may suspend or terminate your account if you (a) breach these Terms, (b) fail to pay after the grace period, (c) use the Platform for illegal purposes, or (d) become insolvent.
  3. Effect of termination. Upon termination: (a) access to the admin dashboard is revoked, (b) your public mosque website will be taken offline, (c) your data will be available for export for 30 days, (d) after 30 days all Tenant data will be permanently deleted.
  4. Survival. Sections on liability, indemnification, governing law, and data processing survive termination.

Limitation of Liability

  1. To the maximum extent permitted by applicable law, Masjida's total aggregate liability under these Terms shall not exceed the fees paid by you in the 12 months preceding the claim.
  2. Masjida shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or business interruption.
  3. Masjida is not liable for (a) the accuracy of prayer times, event details, or other content you create, (b) actions of third-party payment providers, (c) data loss caused by your failure to maintain backups, or (d) unauthorised access resulting from your failure to secure account credentials.

Indemnification

You agree to indemnify, defend, and hold harmless Masjida ApS, its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from (a) your breach of these Terms, (b) your violation of any law or regulation, (c) your processing of Member Data, or (d) disputes between you and your members.

Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or through the Platform at least 30 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms. If you do not agree with the changes, you may terminate your subscription before the effective date.

Governing Law & Disputes

  1. These Terms are governed by the laws of Denmark, without regard to its conflict-of-law provisions.
  2. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation.
  3. If a dispute cannot be resolved within 30 days of written notice, it shall be submitted to the ordinary courts of Denmark, with the City Court of Næstved (Retten i Næstved) as the court of first instance.

Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
